Lasting Powers of Attorney & Office of Public Guardian

Trusts

A trust is a fund which contains cash and/or other assets that are controlled by you and/or other named third parties ("trustees") for the benefit of a specific individual or group of individuals. They are governed by complex legal regulations and separate tax rules. A trust can be set up during lifetime or on death. We can advise you how a trust can help you.

Lasting Powers of Attorney

These are normally granted to enable relatives, friends or professional advisers to administer the affairs of elderly or infirm people who, for whatever reason, are unwilling or unable to manage their own affairs.

There are 2 types of Lasting Powers of Attorney:-

  1. Property and Affairs Lasting Power of Attorney - which allows your attorney to deal with your property and finances as you specify
  2. Personal Welfare Lasting Power of Attorney - which allows your attorney to make welfare and health care decisions on your behalf, but only when you lack mental capacity to do so yourself. If you wish, this could extend to giving or refusing consent to the continuation of life sustaining treatment

Office of Public Guardian

If you lack capacity to make a financial decision then it may be necessary for an application to be made to the Office of Public Guardian for an appropriate order, such as appointing another person to make decisions on your behalf.
